How do I have the Guardian act jointly with the surviving parent BUT for the Substitute Guardian(s) to come in only if no parents survives?

When you list down any Substitute Guardian(s) on our platform's Appoint People tab, they are meant to substitute whoever your main appointed Guardian is (in order of priority) and according to the same choice whether "To act jointly with other parent" or "To act only if no parents survives".


If for some reason you wish to have an appointed Guardian act jointly with the surviving parent BUT for the Substitute Guardian to come in as a replacement ONLY in the event no parents survives (i.e. you do not want any of your listed Substitute Guardian to come in as replacement when the other surviving parent is still alive), you can do so by:

Go to Appoint People tab, select "No guardianship clause" for Appoint Guardian.

Go to Select Clauses tab, toggle on "Other Instructions" and key in the following:

Appointment of Guardians

I appoint my {Relationship}, {Name}, {Identification Number/details} to be joint Guardians with the surviving parent of my minor child(ren). Should any of my appointed Guardians die before me, refuses to act or is unable to act, or his/her appointment does not take effect for any other reason, I appoint the following personnel in order of priority to replace him/her ONLY in the event that no parent of my minor child(ren) survives:

(a) My {Relationship}, {Name}, {Identification Number/details}
(b) My {Relationship}, {Name}, {Identification Number/details} ...
