Can I give my property to my beneficiaries who do not own their own residential property?

Yes, it is within your right to word your Will accordingly. Regardless, you should still update your Will accordingly when circumstances change in the future.

Along the same chain of thought, do consider the following:

  1. Who are the beneficiaries?
  2. What happens if there is more than one of the beneficiaries who do not own their own residential property?
  3. What happens if all of the beneficiaries own their own property?

Presuming it is to be distributed equally amongst the beneficiaries who do not own their own residential property and if all of them own their own properties then it is to be liquidated with the proceeds distributed equally amongst all the beneficiaries,

Under " Additional Instructions"  within the asset key in the following:

This property is to be given to whomsoever of the following beneficiary(s):
- {Relationship}, {Name}, {Identification Number/details};
- {Relationship}, {Name}, {Identification Number/details};
- {Relationship}, {Name}, {Identification Number/details};
who does not have his/her own residential property(s) at the point of my demise. If there is more than one of the said beneficiaries who do not own their own residential property(s) at the point of my demise, this property is to be distributed equally amongst the said beneficiaries who do not own their own residential property(s). If all the said beneficiaries have their own residential property(s) at the point of my demise, this property is to be liquidated and distributed equally amongst all the said beneficiaries.

Example:

If you would like the asset to be distributed in a different manner if all of the said beneficiaries own their own residential property(s), you can use this instead.

This property is to be given to whomsoever of the following beneficiary(s):
- {Relationship}, {Name}, {Identification Number/details};
- {Relationship}, {Name}, {Identification Number/details};
- {Relationship}, {Name}, {Identification Number/details};
who does not have his/her own residential property(s) at the point of my demise. If there is more than one of the said beneficiaries who do not own their own residential property(s) at the point of my demise, this property is to be distributed equally amongst the said beneficiaries who do not own their own residential property(s). If all the said beneficiaries have their own residential property(s) at the point of my demise, this property is to be liquidated and distributed in the following manner:
- XX% to {Relationship}, {Name}, {Identification Number/details};
- XX% to {Relationship}, {Name}, {Identification Number/details};
- XX% to {Relationship}, {Name}, {Identification Number/details}.
