Must the Will be signed in Singapore? Can the testator and his/her two witnesses sign the document together abroad?
It is recommended to sign the Wills generated from getArrange in Singapore.
There are certain requirements in Singapore for making a valid Will. To ensure conformity, we have included these requirements in the signing instructions on Page 2 of all Wills generated from getArrange.com.
As to whether the signing can be conducted overseas, based on Singapore’s Wills Act, one requirement is the Will “shall be treated as properly executed if its execution conformed to the internal law in force – (a) in the territory where it was executed;”
As our signing instructions are crafted based on the formal requirements according to Singapore’s laws and we do not have the expertise on the laws concerning Wills overseas, we recommend having the Will signing (for Wills generated from getArrange) done in Singapore.
Regardless, it is not illegal nor is the Will invalidated by signing overseas, HOWEVER, if you choose to sign it outside of Singapore, please ensure that you comply with the internal laws of that country regarding the validity of the Will. These requirements may differ from those when signing in Singapore. For example, if you choose to sign our Will in certain countries, it may also be necessary to have the Will signed by a notary and/or filed with a registry for it to be considered valid.
