What happens if the trust beneficiaries in my testamentary trust die?

Specific to getArrange Wills, we have clause that primary trust beneficiary(s) can benefit from the trust fund ONLY DURING his/her lifetime(e.g. he/she will not receive any entitled payout after he/she passes away).

If there are remaining primary trust beneficiary(s), the trust will continue paying out according to the instructions set forth to the remaining primary trust beneficiary(s) as per normal.

In the example below, the testamentary trust is meant to benefit the mother and the son. If only the son dies before reaching age 35 (i.e. before he is slated to receive 100% of the balance of the trust fund), the trust will continue paying out to the mother so long as she is alive.

However, if all primary trust beneficiaries have died, any remaining balance of the trust fund will be distributed as per the allocation under “Remainder Beneficiary”.

In the event that ANY Remainder Beneficiary is not alive, the share of the balance of Trust Fund which he/she would otherwise be entitled to receive shall STILL be given to him/her contributing to his/her estate.

Using the same example above and below, if both the mother and son have died and there is still remaining balance in the trust fund, it will be distributed 50% to the brother and 50% to the sister.

And if the brother is not alive at the point in time, he will still receive 50% of the remaining balance of the trust fund contributing to his estate (e.g. to be distributed based on his Will or the distribution of his estate based on the intestacy law applicable to him if he dies without a Will).
