How do I give instructions for the Executor to distribute a particular asset in its existing form (i.e. without liquidating it)?
Certain assets may be subject to terms and conditions imposed by the relevant authorities or institutions, which may make it impracticable or impossible to distribute them in their existing form. For example, HDB flats are subject to eligibility conditions for retention; and accounts or insurance policies may be governed by specific contractual terms; privately owned companies are subejcted to its constituition or any contractual agreements. You are advised to check with the relevant authorities or institutions to confirm any applicable requirements or restrictions.
Additionally, for certain immovable or unique assets (such as an art piece) it may not be practical to distribute them to more than one beneficiary, particularly if the beneficiaries are not on good terms.
If you would like to specify for a particular asset to be distributed in its existing form, you can do so by keying in the following under the "Additional Instructions" within the asset itself:
I direct my Executor(s) to distribute this asset to my beneficiary(s) in its existing form (i.e. without liquidating it).
