How to structure conditional gifts based on the value of your Residual Assets?
If you are uncertain about the eventual size of your estate, but would like to give a specific sum to someone, provided that your Residual Assets exceed a certain value (to ensure sufficient provision for your other beneficiaries), you may include a conditional gift instead.
It makes more sense to obtain an estimate of your estate by consulting a Certified Estate Planner. This enables you to plan effectively and, more importantly, to explore financial solutions that could potentially enhance the size of your estate, rather than omitting gifts to your loved ones if the conditions are not met thereafter.
Under Select Clauses >> Other Instructions, key in the following (edit details as needed):
I give my {Relationship}, {Name}, {Identification Number/details}, a specific gift of {Currency}{Amount} to be drawn from my Residual Assets, on the condition that the net value of my Residual Assets is at least {Currency}{Amount}. This gift shall lapse if the net value of my Residual Assets is less than {Currency}{Amount}.
