How do I add instructions to my Will declaring that it is made in contemplation of a marriage and will not be revoked?
IMPORTANT
The instructions provided are made in contemplation of marriage to a specific person. They do not cover marriage in general, or marriage to any other person.
These instructions do not exclude any obligation to make adequate provision for your dependants under Singapore's Inheritance (Family Provision) Act.
While you are generally free to make your Will as you wish, you should do so with an understanding of the potential risks. Our recommendation is still that you draft a new Will after your marriage to avoid potential disputes or uncertainty.
Generally speaking under Singapore law, if you get married or remarried, your previous Will are automatically revoked upon marriage. This is because you have a new family and the law assumes that you wish to provide for your new family.
However, under section 13(2) of the Singapore Wills Act 1838, a Will will not be revoked by marriage if the Will is expressly stated to be made in contemplation of that marriage.
Nevertheless, it is always safer, and we strongly recommend, that you draft a new Will after your marriage to avoid potential disputes or uncertainty.
To add the instructions, under Select Clauses >> Other Instructions, key in the following:
I declare that I make this Will in contemplation of my marriage to my {Relationship}, {Name}, {Identification Number/details}. I expressly declare that it is my intention that this Will shall remain valid and shall not be revoked by, or by reason of, my marriage to {Name of fiancé/fiancee}, and that this Will shall continue to have full force and effect notwithstanding the solemnisation of that marriage.
