How do I put a generic instruction for all my joint assets to go to the surviving joint owners?
Generally, for joint assets (e.g. joint tenancy for property), the right of survivorship applies. Regardless, you can add in instructions to make it clearer to prevent any ambiguity down the line. Additionally, you might also want to cater for the event where you are the last surviving joint owner (i.e. you would have now fully own the joint assets.)
To apply this for ALL joint assets, under Select Clauses >> Other Instructions, key in the following:
I direct that upon my death, all joint assets, including but not limited to joint bank accounts and any other property held in joint tenancy, shall be distributed equally among the surviving joint owners of the respective joint assets by right of survivorship. If there are no surviving joint owners, these assets shall be redistributed proportionately to the surviving beneficiaries in the following manner:
- XX% to my {Relationship}, {Name}, {Identification Number/details};
- XX% to my {Relationship}, {Name}, {Identification Number/details}.
If you would like all joint assets to be redistributed equally instead of by a fixed percentage, you can key in the following instead;
I direct that upon my death, all joint assets, including but not limited to joint bank accounts and any other property held in joint tenancy, shall be distributed equally among the surviving joint owners of the respective joint assets. If there are no surviving joint owners, these assets shall be redistributed equally among the following surviving beneficiaries:
- my {Relationship}, {Name}, {Identification Number/details};
- my {Relationship}, {Name}, {Identification Number/details};
- my {Relationship}, {Name}, {Identification Number/details}.
If you would like all joint assets to be redistributed according the a specific instruction/allocation set out within the individual asset, you can key in the following instead;
I direct that upon my death, all joint assets, including but not limited to joint bank accounts and any other property held in joint tenancy, shall be distributed equally among the surviving joint owners of the respective joint assets by right of survivorship. If there are no surviving joint owners, these assets shall be redistributed according to the instructions/allocations set out in the individual assets.
For instructions applying to a specific joint asset owned by you and one other joint owner
If you would like to indicate on a specific joint asset which is jointly owned by one other joint owner be given to him/her, list the asset, select "Joint" ownership type, list the other joint owner, and under "Additional Instructions", key in the following:
I direct that upon my death, this joint asset, which is jointly owned by me and my {Relationship}, {Name}, {Identification Number/details}, shall be distributed to him/her by right of survivorship. If there are no surviving joint owners, this asset shall be distributed according to the allocation below.
In the "Allocate asset <3", list the allocation if it ceases to be a joint asset (e.g. after I have inherited it).
Don't be alarm if on the platform the allocation is on the right instead of below as per the instructions. The allocation is below the instructions in the Will itself.
For instructions applying to a specific joint asset owned by you and multiple joint owner(s)
If you would like to indicate on a specific joint asset which is jointly owned by you and multiple joint owners be given to them, list the asset, select "Joint" ownership type, list the other joint owner, and under "Additional Instructions", key in the following:
I direct that upon my death, this joint asset, which is jointly owned by me and the following joint owners:
- my {Relationship}, {Name}, {Identification Number/details};
- my {Relationship}, {Name}, {Identification Number/details};
shall be distributed equally among the surviving joint owners of this joint asset by right of survivorship. If there are no surviving joint owners, this asset shall be distributed according to the allocation below.
In the "Allocate asset <3", list the allocation if it ceases to be a joint asset (e.g. after I have inherited it).
